I'm on the Do Not Call list and they keep calling or texting. Can I do anything about it?

Often, yes. Federal law and Florida's own law limit sales calls and texts. What usually matters:

  • a sales call to your cell phone with a recorded or AI voice, made without the required consent;
  • more than one call within 12 months that violates the Do Not Call rules, from the same company or someone calling for it, to a number on the National Do Not Call Registry;
  • sales calls to a number on Florida's own Do Not Call list;
  • sales texts that keep coming after you replied STOP. To seek damages under Florida's telephone-solicitation law for sales texts, first reply STOP to the sending number; a claim requires continued messages without your consent after the 15-day period.

Whether you have a case depends on the facts: who was behind the calls, whether you ever gave consent, and what you can show. Courts disagree about whether federal Do Not Call claims cover texts and calls to cell phones. Separate rules govern prerecorded and AI-voice calls. Save the evidence first.

What can count

Calls and texts the law may cover

Recorded or AI-voice sales calls

A sales call to your cell with a prerecorded or artificial voice generally needs your prior written consent.

Calls to a Do Not Call number

Registered numbers are off-limits to most sales calls, with exceptions such as a company you recently did business with.

Calls or texts after you said stop

For texts, keep the thread that shows your STOP reply and every text after it. For calls, note the date, the time and the words you used.

What to save

Save the evidence before it disappears

Screenshot the whole thread

The number, the dates and times, your STOP reply and every message after it.

Keep voicemails and your call log

Don't delete anything. Export or screenshot the call log.

Write down what they said

The company, the product, and any transfer to another company.

Don't record or bait them

Don't record a live call without everyone's consent; Florida generally requires all-party consent. Don't reply in any way meant to get more calls or texts.

Federal and Florida law

The rules that decide your case

Federal Do Not Call rule

A federal claim under the Do Not Call rules requires more than one call that violates the applicable rules within 12 months, from the same company or someone calling for it. Separately, the FTC says sales calls can take up to 31 days to stop after you register.

Recorded and AI voices

Calls to a cell phone with a prerecorded or artificial voice generally need prior consent; for sales calls, that consent must be in writing.

Florida's law

Covers calls, texts and voicemails, and Florida's list covers cell phones. To seek damages under Florida's telephone-solicitation law for sales texts, first reply STOP to the sending number. A claim requires continued messages without your consent after the 15-day period. A permitted confirmation text alone does not qualify. Federal claims follow different rules.

The company behind the call

A telemarketer is often calling for another company, and that company can be responsible. If a case is filed, I may be able to obtain phone or messaging records that help identify who was behind the calls or texts. Identification is not always possible.

FCC opt-out rules

Valid requests to revoke consent for covered calls and texts must be honored within a reasonable time, no later than 10 business days. Starting November 25, 2026, companies may designate a permitted opt-out method as exclusive if they clearly disclose it. Save the instructions and your response. Florida's separate STOP requirement for text-damages claims still applies.

Calls that reach many people

If what happened to you happened to many others, the case may be brought as a class action. With your written consent, I may bring in a firm experienced in class actions, and some matters may be referred to another law firm. Adding co-counsel does not create a second fee. In a class action, attorney's fees require court approval.

Questions people ask

Unwanted calls and texts FAQ

Can I sue over one call or text?

Sometimes. One recorded-voice sales call to your cell without the required consent can be enough under federal law. The federal Do Not Call claim needs more than one call that violates the rules within 12 months. A damages claim under Florida's law for sales texts needs your STOP reply and continued messages without your consent after the 15-day period.

How do I get on the Do Not Call lists?

National: DoNotCall.gov or 1-888-382-1222, from the phone you want to register. Florida: the Florida Department of Agriculture and Consumer Services' Do Not Call program. Both are free and include cell phones.

What if I gave the company my number once?

Consent, a recent purchase or a recent inquiry can matter. Tell me everything, including forms you filled out and keyword texts you sent. Some consent can be revoked.

What if the caller hides their number or name?

Write down every detail you heard. If a case is filed, I may be able to obtain phone or messaging records that help identify who was behind the calls or texts. Identification is not always possible.

How much is a case worth?

The amount depends on the claim and what can be proved. Some TCPA claims allow $500 for a qualifying violation, potentially increased to $1,500 if the court finds a knowing or willful violation. Other claims use different measures or allow actual damages. No payment is automatic.

Will it cost me anything?

You owe us no attorney's fees or repayment of advanced case costs unless we recover for you. A court may order you to pay the other side's costs and, in some cases, attorney's fees. I explain these risks before filing.
